Contractual Conditions
- Object of the contract
1.1. The service offered by Home Food S.r.l. Benefit Company exclusively concerns the connection between the User, previously identified during the registration phase for the selected Event, and the Cesarina, whose personal data will be subsequently communicated to the User by email confirming the selected Event. In consideration of this activity, HF receives a variable percentage for each total amount paid by the Guest, already included in such amount, depending on the type of Event offered.
1.2. HF's service does not include anything outside the activity of connecting the User and the Cesarina, in particular, merely by way of example and not exhaustively: the platform does not control and cannot control the performances of Users and Cesarina, and does not guarantee the existence, quality, safety, suitability, or legality of any Service offered or Advertisement or the truth or accuracy of any Advertisement description, Review, or other Content provided.
1.3. The User acknowledges that HF has no general obligation to monitor the use of the HF Platform and verify the information provided by the User and the Cesarina but has the right to examine, disable access, remove, or modify Content to: manage, protect, and improve the Platform (also for fraud prevention, risk assessment, investigation, and customer support purposes); comply with applicable law or the order or request of a court, law enforcement, or other administrative or government agency; deal with Content that HF considers harmful or questionable; take actions set forth in these Terms; maintain and enforce any quality or suitability criteria, also by removing Advertisements that do not meet the quality and suitability criteria. The User agrees to cooperate with and assist HF in good faith and to provide HF with information and take actions that may reasonably be requested by HF, in relation to any investigation undertaken by HF, regarding the use or misuse of the HF Platform.
1.4. HF is not responsible for the quality of food offered by the Cesarina or the compliance with the dietary needs of the Guest. The Platform is also not responsible if the Cesarina does not comply with legal requirements, particularly those concerning food safety. It is specified that the events hosted by the Cesarine take place in domestic settings that are not suitable for ensuring the absence of food contamination.
1.5. When the User and the Cesarina make or accept a reservation, they directly enter into an agreement between themselves. HF is not and does not become a party or other participant in any contractual relationship between the Cesarina and the User. - Service utilization mode
2.1. After selecting the Event, the Guest, to proceed with the purchase, according to the procedure available on the Website, must accept the General and Contractual Conditions, and after reading the Privacy Policy, can use the HF Service and other Services possibly available through the connection methods. During the Event booking phase, the User is required to report any special dietary requirements, and only with the payment of the full Price (for all diners) is it possible to complete the order. HF then confirms via email the successful completion of the operation upon receipt of the total credit, at which point the contract between the Guest and HF can be considered concluded. When the Cesarina accepts the reservation, a contract is directly entered into between the Cesarina and the User.
2.2. The Cesarina may accept or refuse Guests if the received request at the time of booking involves culinary skills or particularly complex requests that they are unable or unwilling to fulfill (see allergies/intolerances). In this case, the Guest will receive cancellation from HF and a full refund of the amount paid.
2.3. The Cesarina cannot accept guests with specific food allergies communicated only at the time of the event. In this case, the guest will not be refunded.
2.4. Access to the Website is free for Users, while all costs of connecting to the Internet network from the computer from which the User uses the Services are borne by the User. The connection methods that HF provides to the User to allow them to book events are suitable for carrying out these activities. HF reserves the right to add new features to the Services or to remove them at its sole discretion. - Guest's responsibility
The Guest is responsible for their actions or omissions and the actions and omissions of anyone they invite to participate in any Experience. For example, merely by way of example, the Guest: is responsible for paying all amounts resulting from Compensation Requests necessary to compensate for the damages caused by them, their guests, or their/their pets; must act ethically, treat others with respect, and follow the applicable laws at all times. If the Guest brings a minor to use a Cesarina's Service, they are solely responsible for supervising that minor. - Use of the services
4.1. To use HF Site Services, users must be of legal age and have the capacity to enter into a legally binding contract.
4.2. At the time of checkout (order completion), the user is required to provide their personal data, including: name, surname, email address, and phone number.
4.3. The contract is considered concluded and binding for the Guest and the Cesarina only upon payment and accreditation, which is promptly communicated by HF, as an intermediary, to the Guest with a confirmation email to the address provided.
4.4. The Guest undertakes and assumes the responsibility to:
• provide all requested registration data truthfully, completely, and updated;
• report any food intolerances and allergies of their own and their fellow diners at the time of booking and/or when redeeming a purchase voucher;
• promptly complete the booking by paying the amount indicated on the portal.
4.5. Unless specified, the purchase of Events without indicating a date or location of realization is to be understood as purchase vouchers and therefore valid and redeemable within and not beyond 12 months from the time of purchase.
4.6. In consideration of its commercial policy, HF reserves the right not to accept purchase orders from parties other than "consumers" or purchase orders that do not comply with its commercial policy, such as orders for which there is a report or suspicion of fraudulent or illegal activity. In such cases, HF will communicate to the user the non-acceptance of the order. All purchase proposals transmitted to HF must also correspond to normal consumption needs.
4.7. The general terms of sale do not govern the provision of services or the sale of products by parties other than HF present on cesarine.com. - Purchase procedure

5.6. The language available to the User for concluding the contract is Italian or alternatively English. Customer service is able to communicate with the User in the same language.
5.7. In case of payment process failure, the Purchase Order will be canceled, and the contract cannot, under any circumstances, be considered perfected. - Payment
6.1. Users are required to make payment in the form of an amount to be paid before the Event. Payment by the Guest includes the VAT required by law. Upon receipt of the amount, HF will issue the regular tax document to the Guest and send it via email.
6.2. Payment of the Total Price indicated can be made using the payment methods accepted by HF and indicated on the site. In particular, it can be made by credit card, using the following circuits: Visa, Mastercard, Amex, Maestro. Under no circumstances will additional costs be charged to the User in relation to the chosen payment method.
6.3. To ensure maximum security, the User will make the payment transaction through a secure connection and directly to the credit institution managing the online payment system. The financial information (e.g., credit/debit card number, expiry date, security code) that the User uses for the payment transaction is encrypted and transmitted directly to the payment processor, without passing through the servers used by HF, which therefore does not have access to such information, nor can it save or archive it.
6.4. The validity of the credit card – or more generally of the payment method selected by the user - may be verified through a pre-authorization for payment. This authorization is not a charge. In any case, the charge to the User's card will be made after the card issuer authorizes the charge, which will be made after the Order Confirmation, subject, of course, to the Customer's right to refund in case of non-performance of the contract for any reason or cancellation of the Purchase Order.
6.5. The User is solely responsible for the entered data and guarantees the use of only credit cards for which they have legitimate availability. HF is not responsible for any fraudulent or unlawful use of credit cards that may be made by third parties at the time of payment by the User.
6.6. Payments for Services via bank transfer or other payment methods other than those expressly indicated on the Site will not be accepted. - Cancellation and Termination
7.1. For bookings made on cesarine.com, the Guest may cancel the Event up to 24 hours before it takes place (unless otherwise specified in the product description of certain exclusive experiences) and receive a full refund from HF. Beyond this period, the Guest may still cancel the Event, but will no longer be entitled to any refund for any reason or cause. The cancellation must be made by accessing the "Your orders" section and clicking the "Cancel this booking" link for the event you wish to cancel.
7.2. For cooking experiences, the Cesarina will wait for the Guest for 30 minutes before considering the event canceled. Prompt arrival is preferred for shared cooking classes. In case of delay, the experience will still end at the scheduled time.
7.3. HF reserves the right to cancel the Guest's reservation at any time due to force majeure, providing a full refund of the amount paid.
7.4. HF reserves the right to cancel the Guest's reservation for any reason within 24 hours prior to the Event, without any obligation to the Guest other than to provide a full refund of the amount paid.
7.5. The refund of amounts paid, as per the previous points 7.4. and 7.5., will be made through the payment method chosen by the Guest at the time of purchase.
7.6. The purchase currency in which orders are made is indicated only at checkout, before payment. Any refunds will be made in the same currency. HF does not assume responsibility for refunding the difference in currency exchange rates that may occur between payment and refund.
7.7 In the event that, along with the experience, a merchandising product — such as, by way of example, a Cesarine-branded apron — has been purchased, the request to cancel the event within the timeframe provided for a refund will not include a refund of the product, as the order may already have been processed, shipped, or customized. - Reviews
8.1. On the Site, Users who have purchased and participated in an Event have the opportunity to write and publish a review related to the Service(s) experienced.
8.2. Users who publish a review declare acceptance and knowledge of HF's Review Policy and undertake to observe it, committing to write and publish only truthful reviews, as closely corresponding to the actual quality of the Service experienced as possible, and not containing discriminatory, offensive, or defamatory language.
8.3. Reviews are presented on the Site in descending chronological order: from the most recent to the least recent.
8.4. HF does everything within its availability to verify the reliability of reviews and, for this purpose, adopts appropriate verification measures, such as, for example: sending invitation links for reviewing a Service experienced by the User; manual verification of the review written by a User, etc. - Search Results
Within the Site, Users can search for Services using various parameters, such as: location (where), date of use (when), and number of guests. The search results generated by the User are ordered based on various criteria, among which the main one is the distance between the location searched by the User and the location where the hosts reside. Some results may be highlighted, through the use of labels - such as, for example, but not limited to: special of the week; recommended; typical experience, etc. - it is clarified that these are not sponsored content. - Ownership
10.1. The contents of the portal, the graphics, the photographs, and every distinctive element, including HF trademarks, are the exclusive property of HF, protected by Italian and international laws, particularly those regarding copyright, intellectual property rights, and may be used by the User solely for the purpose of browsing the Site and using the Services. 12.3. These Conditions must be interpreted, evaluated, and enforced in accordance with the laws of Italian law. The User acknowledges that the Conditions comply with the provisions of Articles 50-61 (distance contracts) of Legislative Decree 206 of 2005 (Consumer Code).
12.4. The ODR platform can be consulted at the following address https://ec.europa.eu/consumers/odr/main/?event=main.home.show. Through the ODR platform, the consumer User can consult the list of ADR bodies, find the link to the website of each of them, and initiate an online dispute resolution procedure in which they are involved. - Disclaimer
13.1. The HF Platform does not endorse or guarantee the existence, conduct, performance, safety, quality, legality, or suitability of any Guest, Cesarina, Cesarina's Service, Listing, or third party and does not guarantee that verification, identity checks, or background checks conducted on the Cesarina (where possible) will detect past misconduct or prevent future misconduct.

13.3. HF manages the Site and the Services and controls their operation from Italy and does not guarantee that the Site and the Services are suitable for use or accessible in any geographical area. In particular, any liability is expressly excluded in the event that the malfunctioning of the Services or the Site depends on a fact dependent on the responsibility of the providers or managers of telephone lines, or from malfunctions of the Internet or telephone network, or in general from any Event not attributable to HF or its collaborators and/or employees, or finally from force majeure or otherwise not dependent on the will or fault of HF.
13.4. The website cesarine.com contains hypertext links to other websites, owned and/or managed by other subjects other than HF to which the User may be redirected. These websites are not monitored or controlled by HF and therefore cannot in any way be held responsible for the products and/or contents of third-party websites. To the fullest extent permitted by applicable law, the Guest, if not a consumer, agrees to release, indemnify, and hold HF harmless from any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting costs, arising from or in any way related to: their violation of these General Terms and Conditions (including any additional or supplementary terms applicable to a product or function), or the Privacy Policy, Review Policy, or Image Use Conditions; the improper use of the Home Food Platform by the Guest; participation in an Experience or the use of other Cesarina Services, which may cause, for example but not limited to, any injuries, losses, or damages (compensatory, direct, indirect, consequential, or otherwise) of any kind arising from or resulting from such interaction, participation, or use; or a violation by the Guest of any law, regulation, or third-party right, such as intellectual property or privacy rights. The indemnification obligation applies only if and to the extent that there is a sufficient causal connection between the claims, liabilities, damages, losses, and expenses and the culpable breach of a contractual obligation by the Guest.
