Conditions of Image Sharing and Release
1. Definitions
"Site": website corresponds to the domain www.cesarine.com
"Home Food": Home Food S.r.l., headquarters in Bologna, Via San Vitale 40/5d, Part. Iva and Fiscal Code 03416251209, Bologna Business Register Entry no. BO-517649, share capital € 22,717.50, company owner of the Site.
"Cesarina": any physical person, over 18 years of age, who has full legal capacity and who provides the Services sold through the Site. Also in the plural form, such as “Cesarine”.
"Service": means a service offered for sale through the Site. By way of example: home restaurant services; cooking classes; food tours, etc... Also in the plural form, such as "Services."
"Content": means any content shared by Cesarine on the Site. By way of example but not limited to: text and/or reviews, images, videos, audio, photos, multimedia and/or audiovisual content in general.
2. Sharing
In order to encourage interaction between Cesarine and users and the conscious use of the Services, Home Food allows Cesarine to spontaneously upload Content to the Site in connection with the Services provided.
Home Food disclaims any liability in the event that a user's personal information is used by an unauthorized Cesarina.
The Cesarina may not, under any circumstances, share commercial Content on the Site that is unrelated to the Site and Services.
3. Intellectual Property
Content posted on the Site by Cesarina remains the property of Cesarina, who may request their removal at any time by writing to legal@cesarine.com
Cesarina is free to post or not post Content on the Site.
By voluntarily sharing one or more Content on the Site, the Cesarina agrees that such Content are in freely accessible on the internet through the Site and/or Home Food's social channels and/or through further forms of diffusion directly and/or indirectly related to Home Food.
Cesarina warrants to have the necessary permissions to publish Content on the Site, in compliance with applicable law and the rights of privacy, personal image, intellectual property, etc.
By publishing the Content on the Site, Cesarina accepts all responsibilities as the publisher of the Content under the law and grants Home Food: i) the right to publish and/or divulge and/or exploit in any way and form, including economically, the Content through any means, none excluded, such as but not limited to, print, video, internet, social networks (Facebook, Twitter, Instagram and others), TV, etc; ii) synchronize the Content with other works of genius and to disseminate, as under i), the material obtained; iii) insert the Content, even in a reworked form, within other audiovisual and/or photographic content of an advertising and/or commercial nature, authorizing as of now its economic exploitation, without any limitation.
By uploading the Content on the Site, Cesarina confirms that she has assigned and transferred to Home Food, exclusively, all the rights to which she is entitled, or which may be due to her by future provisions of law, over the Content, including, but not limited to, the rights of use and economic exploitation of her image and/or voice and/or face, such that Home Food may freely use the Content, in whole or in part, throughout the world and in perpetuity, by any means and methods already invented or to be invented in the future, including for commercial and economic purposes.
Cesarina also confirms that it has no claims by reason of the foregoing and that it irrevocably waives any right, action or claim arising from the foregoing authorization, even if the exploitation of the Content should generate profits.
In the event that the Content should contain the image and/or voice and/or face of third parties - including users who have purchased and benefited from a Service - in uploading the Content to the Site, Cesarina declares and confirms that it has acquired all the necessary authorizations from the persons concerned and undertakes to indemnify and hold Home Food harmless from any claims that third parties may make regarding the Content.
4. Cesarina's Liability.
By posting Content on the Site, Cesarina agrees to release Home Food from any liability and hold it harmless from any damages, costs and charges, direct and indirect arising from the sharing and voluntary posting on the Site of one or more offending Content.
In particular, Cesarina agrees to hold Home Food harmless from any liability directly or indirectly attributable to the publication of Content that portrays/contains the image and/or voice and/or face of third persons.
Any non-compliant Content may be removed from the Site.
